Disclaimer

Post by eMTe »

Just a thought, sory for posting it so late - I dont know if there's place for this in new design.

Shouldnt we put some kind of disclaimer on main site or on game pages, below info panel? Sth like "afawk all games that we host are freeware...blah blah blah...if according to you knowledge some of our games arent freeware...blah blah...please contact us..." or alike.

This will show people that we really care about our PURE freeware status.

It could fit easily in the bottom line, where it also says who coded the site..
It wouldn't have to be any longer than: As far as we know all games on this page is either freeware or permitted for us to host by developer, if you have knowledge of this being otherwise, please write us in the forums, and we will take care of it. OR even shorter....

Or are you thinking of other games...

I like this one:
Chroelle wrote:As far as we know all games on this page is either freeware or permitted for us to host by developer, if you have knowledge of this being otherwise, please write us in the forums, and we will take care of it.
I think the other suggestion is too short. In my oppinion it looks like we don´t really care about it.

True... I was not all together satisfied with it either...
I was going for a short version that could fit anywhere...
We could of course make a disclaimer page.... And then simply have a link to it in the bottom...
A disclaimer could also include the information that we take no responsibility of any damage done to computers by downloading games from here. (You never know if there is something with a virus hiding in here...)
Also the forum might need a disclaimer in style of: Subjects and replys in this forum is a work of members and not the sites administration, and we can as such not be held responsible for any harm done by this. We do however try to keep an eye out... something something...

Yes, in some sort of time window :) And if you plan to 're-pack' the games, a copy of disclaimer could be added in the package too :)

Good idea. I will try to remember this...
I will start on the disclaimer right away. Any time window will do, as long as it gets done :D

Here is a version 1. Please tell me if there is anything in it that needs revision or if I left something out. I think I got around most problems that I feel can arise. I also attached it.

Disclaimer

Forum content
CWF and it’s administration is in no way responsible for any content on this forum not written by themselves. We also keep the right to get misunderstood! Any flaming, pornographic, discriminating post will be removed from the forum as soon as a member of the moderation team sees it. This means that some posts of bad content can be present for a period of time, but no longer than it takes a moderator to appear in the forum and read the post.

Games
CWF does not in any way claim any ownership or special rights to any games on the site, unless otherwise noted. CWF also makes an effort to search permission to offer the games we have on the site. In some cases the developer has not left a forwarding address and we do not see any means to contact them, and in these cases we go by the common consensus regarding the games status (if LOTS of other freeware sites portray this game as freeware then we will too.) We seek to be the most legal operation out there, so that you as a member do not have to fear that you are committing a violation of a law of some kind downloading games from our site.
Please contact us if you are aware of any games that should not be on this site.
We hold the right to have acted in good faith. Any violation that we are made aware of will mean an immediate removal of the game in question from our site.

Once you have downloaded a game
CWF also makes an effort to clean up the downloads of virus, spyware, adware and other harmful files. We are not and do not claim to be professionals at this and as such, some malware might get through and into your system. We are in no way responsible for any harm that comes to your computer from downloading or executing a game or tool on this site. We do however try out all gamefiles on our own crews computers so the files are opened, checked and repacked when you receive them.

Financially
CWF is a freeware gamesite, and do not in any way try to make a profit. We are aware that developers made the games to be freely available to members. We honour this, and applaud it. Any income generated on ads and from donations will be used to make the site bigger, cover expenses and help out developers in any way we find necessary. All income not used on this project will go to some form of charity. This means that when you click an ad or donate money to CWF it either ends up helping the site run, help a talented developer make more games, or helps a charity make the world a better place to live. Now if you are a developer and wrote in your license file that you did not want your game represented on sites which holds ads, and still feel that we are violating your rights, please let us know. (You egocentric maniac!)
Any payments (if any) that members choose to make to CWF will be happily received and spent on afore mentioned projects.

Lifetime warranty of something
This term is misunderstood by many people on other sites. If you for example get an email-address under the terms “for life” then we are here referring to the life of CWF and not you. This means that such addresses will be cancelled if CWF is cancelled. We will however make you aware of two facts regarding this:
1. CWF is a very young site and we do not expect to die anytime soon!
2. You will of course be notified in good time if this is in fact the case.
You do not have the required permissions to view the files attached to this post.

If there's no feedback then probably your text is perfect and there's nothing to add... ;)

I like it very much. It's long (so it shows that we really care) and it's honest. It contains everything good disclaimer should contain.

I hope this is the feedback you expected... 8)

I also like the disclaimer very much. It´s long, shows we care and includes everything I could think of. Well done, Chroelle!!! :goodjob:

Forum Content: CWF and/or its administration will not be held responsible for any content posted by members on this site. Any illegal, pornographic, or offensive material will be removed by the moderator team as quickly as possible. This means that some material may be present for a short period of time. If you are the copyright holder of material posted on this site without permission, and want it removed, please contact the Administrators.

Games: CWF does not in any way claim any ownership or special rights to any games on this site, unless otherwise noted. CWF also makes all efforts to obtain permission for use from the game owner/creator/copyright holder before placing the game for download. In some cases the developers have ceased to operate, and cannot be contacted. In those cases, we use other methods to determine the freeware status of the game. This site does not knowingly host illegal downloads, and members can be assured that all games offered here are 100 percent legal.

Please contact the Administrators if you believe any game hosted on this site is not freeware and should be removed. We hold the right to have acted in good faith. Any violation that we are made aware of will mean an immediate removal of the game in question from our site.

Downloads: All games offered for download on this site have been opened, checked and repacked by dedicated staff members. Every effort is made to find and remove any and all viruses, adware or malware that may be present. CWF and/or its Administrators will not be held responsible or liable for any damage to computer systems that may be caused by downloads from this site. Members are urged to use anti virus software to double check all downloads before installation.

Financial Policy: CWF is a Freeware game site, and all games will always be available free of any charge to members. We are aware that developers made/released these games to be freely available to all, and not for profit. We honour this, and applaud it.

Income generated on advertisements and/or donations to CWF will be used to improve the site, cover expenses, and assist in the development of new freeware games. Any excess money will be donated to charity.

If you are a developer, and your license file states that you do not want your game available for download on sites which hold advertisements, please contact an Administrator if you want that game removed from this site.

Site Offered Services: CWF and/or its Administrators reserve the right to change, cancel or otherwise alter any service offered on and/or by this website at any time. This includes, but is not limited to, email addresses, download requirements, forum access, membership requirements and terms of service.
Well, you asked for it .

Please don't kill me for this, but I want to be honest.

Thought it was a bit wordy and confusing. Some parts of it I had to read a few times before understanding what it said. I've gone through and condensed it down a bit, tried to give a more professional tone, and cleaned up the spelling and grammar mistakes I could find. Prettied it up with the colours too, just because I like colours :p.

I also removed bits like this "We are not and do not claim to be professionals at this". Heck, we don't need to tell them that. That could work against the site by making new members feel they need to be worried about downloads because the staff don't know what they're doing. Not a good image I feel ;).

In doing this, I've probably killed much of what you wanted to get across with it though. If you still want to use any of my rewrite, feel free.

I might mix and match :D

Thanks for the very thorough feedbeck Pridy. Only part I am sure that will come back (at least for now) is the part Pater Alf mentions, because I like that too. :D

I very much liked the last part. I was going for something like that in my own last section, but couldn't get it right...

The last bit was the part that confused me the most. I really had to think about what you were trying to get at there. Am pleased you are happy with what I changed it to
